1. Contract Formation

1.1 A binding contract is formed upon receipt of your booking confirmation and deposit by the Company.
1.2 By booking a trip, the Client affirms that they have read, understood, and agreed to be bound by these Terms and Conditions.

2. Deposits and Payment

2.1 A non-refundable deposit of 30% of the total trip cost is required at the time of booking, unless otherwise stated.
2.2 The remaining balance must be paid no later than 30 days prior to the tour commencement date.
2.3 Failure to remit payment in full by the due date may result in cancellation of the booking and forfeiture of any payments made.
2.4 All payments must be made in the currency and method stipulated in your invoice. Clients are responsible for any bank fees incurred.

3. Cancellations and Refunds

3.1 All cancellation requests must be submitted in writing via email and are subject to the following charges:

– More than 30 days before arrival: 90% refund of total payment
– 21–29 days before arrival: 70% refund
– 15–20 days before arrival: 40% refund
– 8–14 days before arrival: 20% refund
– 0–7 days before arrival: No refund

3.2 Refunds are subject to the policies of third-party suppliers (e.g., lodges, airlines, national parks). Penalties or non-refundable charges imposed by third parties will be deducted accordingly.
3.3 All refunds will be processed within 30 days of cancellation confirmation, less any applicable transaction or administrative fees.

4. Changes and Amendments

4.1 Requests for changes to bookings must be made in writing.
4.2 We will endeavor to accommodate reasonable requests but cannot guarantee availability.
4.3 Any additional costs incurred due to changes will be the responsibility of the Client.

5. Travel Insurance

5.1 It is a condition of booking that all Clients obtain adequate travel insurance prior to travel.
5.2 Insurance should cover, without limitation: medical expenses, trip interruption, trip cancellation, personal liability, and loss or damage to property.

5.3 Nirvana Trails is not liable for any costs incurred due to lack of proper insurance.

6. Client Responsibilities

6.1 Clients must ensure that all travel documents (passport, visa, vaccinations) are valid and in order prior to travel.
6.2 Clients are expected to behave respectfully and lawfully during the trip. The Company reserves the right to remove any participant whose behaviour endangers themselves or others.

7. Liability & Force Majeure

7.1 Nirvana Trails shall not be held liable for any loss, injury, death, damage, delay, or cancellation resulting from events beyond our control, including but not limited to: natural disasters, war, pandemics, civil unrest, government actions, or transportation delays.
7.2 In such cases, refunds may not be possible, though we will work to reschedule or offer future travel credit where possible.

8. Health and Safety

8.1 Clients must inform the Company of any medical conditions or dietary restrictions prior to travel.
8.2 Participation in adventure activities is voluntary and at the Client’s own risk. Clients must be in good physical condition for activities like trekking, safaris, and hikes.

9. Governing Law and Jurisdiction

9.1 These Terms and Conditions shall be governed and interpreted in accordance with the laws of the United Republic of Tanzania.
9.2 Any dispute arising under or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts in Arusha, Tanzania.

10. Amendments

10.1 Nirvana Trails reserves the right to amend these Terms and Conditions at any time without prior notice. The version in effect at the time of booking shall apply.
